SERIOUS  Terms of sale 

 

PRELIMINARY ARTICLE

The conditions are concluded between, on the one hand, the ESIDO sprl( for SERIOUS Brand), hereinafter referred  to as "Seller,and, secondly, those wishing to make a purchase via the website Serious http://www.weloveserious.com hereinafter, "the customer". The customer declares to have read these terms and conditions before placing an order. The validation of the order implies acceptance of these terms of sale.

ARTICLE 1 SCOPE

These general conditions apply to all customers for the products sold via the e-shop SERIOUS.

ARTICLE 2 ORDER

Before submitting the order, the customer can check his selection and the total price of the order, including shipping, and correct if necessary. Upon receipt of the order, a confirmation email will be sent to the client. At this time, the sale will be concluded. All items are subject to their availability. If there are difficulties regarding the supply of items, or there are no more left in stock, the seller will propose substitute products . If the client do not wish them, the seller will reimburse any amount that may have been paid.

ARTICLE 3 PRICE OF ARTICLES

The price of items is inclusive of all taxes.The seller can change the price on Serious site at any time without notice. However, as modified price shall apply only to new orders and not to those which have already be accepted.

ARTICLE 4 PAYMENT

The settlement of customer purchases is by credit card: accepted network "CB"cards, Visa, Eurocard/Mastercard and American Express or by Paypall system. Your credit card is charged at the time of preparation of the order. The customer provides his bank details at the time of the order. The seller is not responsible for the costs charged by the issuer or by the customer's bank on the occasion of payment .

ARTICLE 5 DELIVERY

Orders will be delivered to the delivery address specified by the customer on the order form. The goods will take place at the client after the registration of the amount of the order. The delivery of items ordered takes at the latest within 10 working days from the day followingt his  order, subject to full payment. The seller will deliver the items ordered via Bpost. Any deadline provided by the seller will be only for information. If upon delivery, the external appearance of the package is not perfect, the customer will conduct its opening in presence of the carrier to check the status of the article. In case of damage to the article, the customer will detail precisely on the delivery form. From the time the customer received his article, he bears all risks of damage or loss of the article.

ARTICLE 6 EXCHANGE -RETURN

The seller wants to offer his customer the opportunity to exchange the items delivered under the conditions described below. The customer may , at his option, within fourteen days from the date of delivery, to exchange or return items purchased. The customer must return the items delivered in their original packaging, complete ensuring protect properly and must accompany the receipt and waybill at the registered office of the seller. It is for the customer to keep proof of his return. Items returned incomplete, damaged,  or soiled by the customer will not be refundable or exchangeable. The articles may not be washed and must carry their label. In case of exchange, the initial sale will be canceled. Payment for the new sale will be made by offsetting the amount of the previous sale, provided that every overpayment will be an asset for the client or refund. If return, once it accepted, the customer will receive a confirmation email, indicating the refund to his account in the coming days, and will be refunded as soon as possible, and not later than 14 days from the date of the refund  confirmation email. The costs of returning the items are in charge of the customer.

ARTICLE 7 INFORMATION OR COMPLAINT

ARTICLE 8 LIABILITY

For all stages of access to the site, the ordering process delivery or subsequent services, the seller is not a debtor that obligation means. The seller's liability  can not be incurred for any inconvenience or damage arising from the use of internet, including interruption of service, external intrusion or presence of computer viruses or any other incident of force majeure, in accordanc with jurisprudence. Links from our website may be provided for information purpose and the seller has no control over the content of thoses websites. Therefore, the seller shall not accept any liability for any damage deriving from their use.   Items are shipped by the usual postal services or courier. Seller disclaims any liability for too long delivery time due to postal services or transport, and in case of loss of the ordered products or strike. Transport risks are borne by the customer, who will introduce applications for use with the postal services or with the carrier.

ARTICLE 9 DATA PROTECTION -RESPECT FOR PRIVACY

The seller collects personal data about customers, which are available to him on Serious site. In this way, the customer guarantees that he uses his real identity and the information he provides is real , accurate, complete and current at the time he communicates. The seller agrees not to disclose such information to third parties. These are confidential. They will be used by his internal departments only for processing orders.According to european and national laws, the customer can exercise his right of access to the file and his right to rectify the information about him. He can exercise his right to delete information about the mail at the registered office of the seller.

ARTICLE 10 RIGHTS OF INTELLECTUAL PROPERTIES

The SERIOUS brand and all trademarks, figurative or otherwise, and all other trademarks, trade names, service marks illustrations, images, logos and designs registered or not, copyrights and patents appearing on products in the E-shop SERIOUS on accessories or packaging, wether registered or not, are and remain property of the seller. Reproduction in whole or in part, modification  or use of intellectual property for any reason or in any form whatsoever, is strictly prohibited without prior  written permission from the seller. This prohibition also applies to any combination or use associated with any other mark, symbol, logo, or more generally, any distinctive sign intented to compose a logo. Any single link or hyperlink is strictlyprohibited without the express consent of the seller.

ARTICLE11 NULLITY

In the event that any clause of this contract is null and void by a change in legislation , regulation, or court decision, this does not in any way affect the validity and enforceability of these terms and conditions of sale. The general conditions and the order summary sent to the customer form a contract and constitute the whole of the contractual relationship between the parties.

ARTICLE 12 AMENDMENTS TO THESE TERMS AND CONDITIONS

The seller reserves the right to change these terms at any time. The customer and any contract of sale shall be subject to the version of these general conditions in force at the time the customer places his order.

ARTICLE 13 FORCE MAJEURE

The seller can not be liable for any delay or any failure in the performance of his obligations under these  terms and conditions if the delay or failure is due to any cause  not beyond his control.

ARTICLE 15 LAW AND JURISDICTION

These conditions are subject to belgian law. In case of dispute, Belgian law is applicable and only the courts of the judicial district of Liège are qualified.

ARTICLE 16 DURATION

These conditions apply troughout the line-up of the services offered by the seller.
